Simplifying the transfer of a business
As for a European Example, the Senate has adopted 50 measures to simplify the transfer of companies. An economic issue that France can no longer neglect.

According to a BPCE study, 70,000 companies are transferred each year. 45,000 of these are very small companies, 15,000 are SMEs and ETIs and 10,000 are tradesmen. However, this level is still not sufficient and many transactions do not succeed.
This is why the senators have decided to simplify the transfer of business. By clarifying the legal environment of the transmissions and by lightening the administrative steps.
Measures to simplify the transfer of a business
Among the proposals, it is a question of facilitating the steps to benefit from the exemption provided by the Dutreil pact with the tax authorities. There is also talk of removing the mandatory legal mentions on the deed of sale of a business. Finally, the senators propose the digitization of the formalities of publicity of the transfer of shares of a civil company with the Trade and Companies Register. Finally, it would no longer be necessary to transmit the accounting books of the last 3 financial years. An inventory would be sufficient.
Giving more visibility to the transfer of business
For years, the transmission of society has been discredited. With the aging of the population and the obvious economic stakes, politicians and legislators decided to tackle the issue. The measures to simplify the transfer of a company aim at encouraging young people and creators. Indeed, in the last few years, the incentives to create a company have multiplied. Creating a form of economic imbalance.
But the dislike of entrepreneurs is also cultural. In a France that values start-ups, people don’t always think of taking over an existing business. However, the family transmission is a guarantee of success. And there is nothing to prevent young buyers from instilling a new mentality in the company they decide to acquire.
A bill for the second semester
The Pact bill (for action plan for the growth and transformation of companies) should be presented in mid-April in France by the ministers. Beyond family transfers, it should also simplify the transfer of the company to employees.
